1. Acceptance of Terms
Welcome to MEGA Automations ("MEGA Automations," "we," "us," or "our"). By accessing or using the services provided by MEGA Automations, including our website at trymegasuite.com, and any related tools, platforms, or communication methods (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms apply to all users of the Services, including both our direct clients (cosmetic practices like dentists and spas) and individuals interacting with systems or communications managed by us on behalf of our clients ("End Users").
If you are using the Services on behalf of a company or other legal entity (e.g., if you are a representative of a cosmetic practice using our services), you represent that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, do not use the Services.
2. Description of Services
MEGA Automations is a marketing and technology agency that provides services to cosmetic practices (such as dentists and spas). Our Services may include, but are not limited to, marketing automation, customer relationship management (CRM), website development, funnel building, email marketing, and SMS text messaging services, all aimed at helping our clients communicate with and market to their customers/patients.
When you, as an End User, interact with a website form, landing page, or communication sent via our platform on behalf of a MEGA Automations client, you are subject to these Terms regarding your use of that interaction point, in addition to the Privacy Policy and Terms of Service of the specific cosmetic practice you are interacting with.
3. User Obligations
Clients: Clients agree to provide accurate and complete information to MEGA Automations, ensure they have obtained all necessary consents and comply with all applicable laws (including data protection and telemarketing laws) regarding the information they provide to us and the communications sent on their behalf.
End Users: If you are an End User interacting with services provided by MEGA Automations on behalf of a client, you agree to provide accurate information in any forms or interactions. You agree to use the communication channels (like SMS) responsibly and understand that standard message and data rates may apply.
Prohibited Conduct: You agree not to use the Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Services. Prohibited activities include, but are not limited to: sending unsolicited marketing messages (spam) without proper consent, harassment, spreading malware, or attempting unauthorized access to our systems or client data.
4. SMS / Text Messaging Policy
MEGA Automations, on behalf of its cosmetic practice clients, may use SMS (Short Message Service) / text messaging to communicate with individuals who have explicitly opted-in to receive such communications. This section describes the terms applicable to our SMS program:
Opt-In Consent: You agree to receive text messages from or on behalf of MEGA Automations clients if you have provided your express written consent (which may include electronic consent, such as submitting a web form with a clear checkbox indicating your agreement to receive text messages). You may opt-in to different types of messages (e.g., transactional/service-based, promotional/marketing) depending on the options presented to you at the time of opt-in.
Types of Messages: Messages sent may be transactional in nature (e.g., appointment confirmations, reminders, service updates) or promotional/marketing (e.g., special offers, news, promotions), depending on your opt-in preferences.
Message Frequency: Message frequency will vary depending on your interactions with our clients and your opt-in preferences.
Message and Data Rates: Standard message and data rates from your mobile carrier may apply to all SMS messages sent to or received from us or our clients via our platform. You are responsible for any such charges.
Opt-Out: You can cancel the SMS service at any time by replying STOP or QUIT to any message you receive. Upon sending "STOP" or "QUIT", we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from that specific SMS program or client. To re-subscribe, you must opt-in again through the initial method (e.g., submitting a form).

Support: For all questions about the services provided by our clients, please contact the specific cosmetic practice directly. For questions about the SMS platform itself or opt-out issues, contact MEGA Automations.
Disclaimer: Carriers are not liable for delayed or undelivered messages. We or our clients may suspend or terminate your SMS service if we believe you are breaching these Terms.
Consent Not Condition of Purchase (Where Applicable): Where legally required and specified at the point of opt-in, your consent to receive marketing text messages is not required as a condition of purchasing any goods or services. (Note: Please ensure this aligns with the specific A2P registration requirements and the language used on your forms, as mentioned in the video).
5. Intellectual Property
All content provided by MEGA Automations as part of the Services, including text, graphics, logos, software, and the compilation of such content, is the property of MEGA Automations or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content without express written permission from MEGA Automations.
Clients retain ownership of their data and content provided to MEGA Automations for use with the Services. MEGA Automations is granted a license to use this content solely for the purpose of providing the Services to the client.
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MEGA AUTOMATIONS MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MEGA AUTOMATIONS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MEGA AUTOMATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL MEGA AUTOMATIONS'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT YOU HAVE PAID TO MEGA AUTOMATIONS FOR THE SERVICES IN THE PAST SIX MONTHS, IF ANY.
8. Indemnification
You agree to defend, indemnify, and hold harmless MEGA Automations and its owner, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Services; (b) any violation by you of these Terms; (c) any violation by you of any third-party right, including without limitation any privacy right or intellectual property right; or (d) your violation of any applicable law, rule, or regulation. This defense and indemnification obligation will survive these Terms and your use of the Services.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of CT, without regard to its conflict of law principles.
10. Dispute Resolution
Any dispute arising out of or related to these Terms or the Services shall be resolved through binding arbitration in Derby, CT in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted by a single arbitrator. The decision of the arbitrator shall be final and binding. Notwithstanding the foregoing, MEGA Automations may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of its intellectual property rights or other proprietary rights.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
